1 Definitions
Carbon Yachts, we, our or us means Carbon Yachts Pty Ltd (ABN 71 666 574 670) whose registered office is 1856 Pittwater Road, Church Point NSW 2105, Australia.
Awake means Ride Awake AB of Frihamnsgatan 26, 115 56 Stockholm, Sweden.
Website means www.rideawake.com.au & carbonyachts.com.au (or any successor URL operated by Carbon Yachts for the sale of Awake Products in Australia).
Product or Products means any Awake jetboard, e‑foil, battery, accessory or spare part offered for sale or pre‑order on the Website.
Pre‑Order means an order you place and pay a Deposit for Products not yet available for immediate delivery.
Order means the specific Products you purchase from us (whether a Pre‑Order or in‑stock sale) as confirmed in our checkout or an order confirmation issued by one of our sales representatives.
Deposit means a non‑refundable amount you pay to reserve Products for future delivery.
Purchase Price means the price (inclusive of GST and standard shipping to your nominated Australian address) payable for the Products under your Order.
Purchase Agreement means these terms, together with any policies referenced in them.
2 General
This Purchase Agreement constitutes the entire agreement between you and Carbon Yachts for the purchase of Products. By submitting an Order and paying the Purchase Price (or Deposit, in the case of a Pre‑Order) you agree to be bound by this Purchase Agreement.
3 Your Purchase
We agree to supply, and you agree to purchase, the Products specified in your Order on these terms.
4 Orders, Changes & Availability
Products will be supplied in the configuration shown in your Order confirmation.
From time to time certain Products may become unavailable. If so, we will contact you to discuss suitable alternatives.
You may request changes before dispatch. Acceptance of changes is at our discretion and may affect the shipping timeline and Purchase Price.
If you select alternative Products:
a. You must pay any increase in Purchase Price before shipment;
b. We will refund any decrease in Purchase Price; and
c. This Purchase Agreement continues to govern the revised Order.
5 Payment, Deposits & Cancellation
The Purchase Price (or Deposit for Pre‑Orders) is payable at checkout or as otherwise invoiced.
Unless required by Australian Consumer Law, Orders are non‑cancellable once payment is received.
Deposits are non‑refundable, reflecting the costs we incur reserving inventory.
If your balance payment for a Pre‑Order or Deposit is not received within seven (7) days of notification that the Products are ready to ship, we may re‑allocate the stock and retain your Deposit.
6 Shipping, Duties & Other Costs
Standard shipping within Australia is included in the Purchase Price.
We ship Delivered‑At‑Place (DAP) to your nominated address. Title and risk pass on delivery (see clause 11).
Remote‑area surcharges or special delivery requirements are your responsibility; we will advise you of any additional costs prior to dispatch.
International customers should contact us before ordering; additional duties, taxes or compliance costs may apply.
7 Shipping Dates & Force Majeure
After we receive your cleared payment we will provide an estimated shipping window. All dates are estimates only.
Delays may occur due to manufacturing, logistics or events outside our reasonable control (Force Majeure). We are not liable for consequential losses caused by shipping delays.
8 Returns
Save for your rights under Australian Consumer Law (see clause 10) all sales are final and we do not accept change‑of‑mind returns.
9 Warranty & Support
All Products are covered by the Awake Consumer Warranty set out at www.awakeboards.com/warranty (or provided in the box).
Awake handles all warranty assessment, service and technical support. You must lodge warranty and technical enquiries directly with Awake via the Awake Link App or support@awakeboards.com.
Carbon Yachts will assist with logistical coordination if reasonably required but is not responsible for warranty determinations.
Nothing in this clause limits your rights under Australian Consumer Law.
10 Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Where permissible, our liability is limited to the remedies in sections 64A(1) and 64A(2) of the Competition and Consumer Act 2010 (Cth).
11 Title & Risk
Title to, and risk in, the Products passes to you on delivery to the address specified in your Order.
12 User Guides & Safety
Each Product ships with a User Guide and safety instructions. You must read and follow these materials before assembly or use.
You acknowledge that riding electric watercraft carries inherent risks, including serious injury or death. You use the Products at your own risk.
To the fullest extent permitted by law, you waive and release Carbon Yachts and its directors, employees and agents from liability for loss, damage or injury arising from your use of the Products, except where such liability cannot be excluded.
13 Registrations & Local Compliance
It is your responsibility to ensure that operation of the Products complies with all local maritime, environmental and safety regulations. Carbon Yachts makes no representation that the Products are approved for use in any specific jurisdiction.
14 GST
All amounts are inclusive of GST unless stated otherwise. If GST applies, you must pay the GST amount at the same time as the consideration for the supply.
15 Privacy
We handle personal information in accordance with our Privacy Policy available at www.carbonyachts.com.au/privacy.
We and Awake may use your contact details to provide order updates and product support. You can opt‑out of marketing communications at any time.
16 No Exclusions
Nothing in this Purchase Agreement excludes, restricts or modifies any condition, warranty, right or remedy that cannot be excluded under applicable law.
17 Governing Law & Jurisdiction
This Purchase Agreement is governed by the laws of New South Wales, Australia. The parties submit to the non‑exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
18 Severability
If any provision of this Purchase Agreement is held to be invalid or unenforceable, that provision will be severed and the remainder of the Agreement will remain in force.
